The complaint, lodged in the New York Supreme Court in Manhattan on October 22, 2025, asserts that lawyers representing the First Lady issued a massive defamation threat. This action, Wolff contends, was a deliberate effort to intimidate him, suppress his ongoing investigation, and ultimately “harass, punish, and chill his right to free speech.”

The Genesis of the Dispute: Epstein Connections and a Retracted Story

The controversy originated from comments Wolff made to The Daily Beast, where he purportedly linked Melania Trump to Jeffrey Epstein. Epstein, who died by suicide in a Manhattan jail in 2019 while awaiting trial on federal sex trafficking charges, had a known association with Donald Trump during the 1990s and early 2000s.

Following Wolff’s remarks, Melania Trump’s attorney, Alejandro Brito, dispatched a letter demanding a public retraction, an apology, and a “monetary proposal” to Mrs. Trump to “ameliorate the harm.” The letter explicitly warned Wolff of a potential $1 billion lawsuit should he fail to comply.

In the wake of this threat, The Daily Beast retracted the contentious story, originally titled “Melania Trump ‘very involved’ in Epstein scandal: author,” from its website. An editor’s note explained that the piece “did not meet our standards.”

Wolff’s Counter-Action: An Anti-SLAPP Defense

In response to what he describes as an attempt to stifle journalistic inquiry, Wolff filed an anti-SLAPP (Strategic Lawsuit Against Public Participation) complaint. New York’s anti-SLAPP law is specifically designed to protect individuals from lawsuits intended to chill speech on matters of public interest.

Wolff’s lawsuit contends that his remarks were taken out of context and that he never defamed the First Lady. His legal team argues that Melania Trump’s claims were made “for the sole purpose of harassing, intimidating, punishing or otherwise maliciously inhibiting Mr. Wolff’s free exercise of speech,” as detailed in court documents obtained by The Wrap.

The filing further asserts that the threats are part of a broader strategy by the Trumps to impede legitimate investigations into the Epstein matter. Wolff’s complaint describes this pattern as designed to “create a climate of fear in the nation so that people cannot freely or confidently exercise their First Amendment rights.”

A Pattern of Litigation: The Trumps and Their Critics

The complaint highlights a perceived history of the Trumps using costly legal threats against those who speak out. Wolff’s filing elaborates: “Mrs. Trump and her ‘unitary executive’ husband along with their MAGA myrmidons have made a practice of threatening those who speak against them with costly SLAPP actions in order to silence their speech, to intimidate their critics generally and to extract unjustified payments and North Korea-style confession and apologies.”

This is not the first instance of Melania Trump engaging in such legal action. In 2017, she reportedly received $2.7 million in a defamation settlement from The Daily Mail after the tabloid published an article questioning her past career. Moreover, in the final year of Donald Trump’s presidency, his Justice Department sued Stephanie Winston Wolkoff, a former adviser to Melania, over her tell-all book, a suit later dropped by the Biden administration. Donald Trump himself has recently pursued a $10 billion defamation lawsuit against The Wall Street Journal over an article detailing an alleged letter to Jeffrey Epstein.

Wolff’s Ambition: Deposing the Trumps Under Oath

Beyond simply fending off the lawsuit, Michael Wolff has expressed a keen interest in leveraging the legal proceedings to pursue discovery. He aims to bring both Donald Trump and Melania Trump under oath to uncover details of their relationship with Epstein.

In a video shared on Instagram, Wolff candidly stated: “To be perfectly honest, I’d like nothing better than to get Donald Trump and Melania Trump under oath in front of a court reporter and actually find out all of the details of their relationship with Epstein.” This sentiment underscores his broader investigative objective to shine a light on an area he believes the Trumps have consistently sought to suppress, as reported by NBC News.

Wolff is not only seeking to prevent further threats but also requesting the court to order Melania Trump to pay his legal fees, as well as compensatory and punitive damages. He states that the First Lady’s claims “impede and chill future reporting and writing that Mr. Wolff has committed to doing regarding Epstein, Mr. Trump and Mrs. Trump,” emphasizing that this is likely the primary goal of her legal actions.
