Judge Ellis has extended Bovino’s questioning from two to five hours, specifically to address the recent use of force in Little Village and other incidents.

Deputy ICE Field Office Director Shawn Byers claimed the pastor failed to comply with commands to leave federal property.
  • October 12 Albany Park Incident: Federal agents deployed what appeared to be a chemical agent to deter a crowd in Albany Park. Customs and Border Protection (CBP) Deputy Incident Commander Kyle Harvick defended the action, calling it an “enforcement action” rather than a planned protest, where the longer agents remained, the more dangerous the situation became.
  • October 14 East Side Car Chase: A Border Patrol car chase ended in a crash on Chicago’s East Side, leading to a “hostile” crowd forming, which agents then dispersed using tear gas canisters. This incident, along with the Albany Park event, was a primary focus of an October 20 hearing where Ellis questioned DHS leaders.
  • October 19 Rolling Meadows Incident: A federal agent was recorded pointing a weapon at bystanders outside an ice cream shop in the suburb of Rolling Meadows.
  • Recent Old Irving Park Deployment: On a Saturday prior to Bovino’s court appearance, CBP agents detained a construction worker in Old Irving Park, leading to a crowd forming. Tear gas was reportedly deployed, and a neighbor claimed to witness two people, including a 70-year-old man, being “tossed to the ground.” The DHS stated agents were “surrounded and boxed in by a group of agitators” and used crowd control measures to safely clear the area after multiple warnings.
