The 5-year-old climbed onto the railing, lost her balance, and fell approximately 49 feet into the Atlantic Ocean below.

The father, who was walking about 10 feet ahead, heard his wife scream. Upon realizing his daughter was in the water, he initially ran to get help, but after about 45 seconds, made the courageous decision to jump overboard to attempt a rescue. This swift action triggered the ship’s man overboard alarm, which had not been activated by the child’s smaller size. Within 20 minutes, the ship’s rescue boat successfully retrieved both the child and her father from the water.

While the child sustained no physical injuries from the fall itself, both she and her father were treated for hypothermia and lactic acidosis. The father also suffered two spinal fractures from his repeated attempts to keep his non-swimming daughter above the surface while treading water for an extended period, as detailed in reports obtained by CBC News.

Instead, she “felt like there should be coverings on the windows, and cited that Disney is responsible for what had occurred,” according to the police report. Detective Christopher Favitta of the sheriff’s office noted that “upon looking at the window myself, as a prudent person, I immediately saw that the window was open to the air, and did not have a covering.” He characterized the fall as “avoidable,” stating that the mother’s act “facilitated by [the mother] placed the child in a life-threatening situation.”

However, the Florida’s Broward County State Attorney’s Office ultimately declined to prosecute, closing the case without charges. Assistant State Attorney Melissa Kelly explained in a report obtained by People Magazine, “While the defendant’s conduct is arguably negligent and irresponsible, it does not rise to the egregious level of conduct necessary to establish criminal culpable negligence.”
