The eight-vehicle chain-reaction crash occurred on westbound Interstate 10, approximately 26 miles west of San Bernardino, when Singh’s tractor-trailer failed to stop in slowed traffic. California Highway Patrol Officer Rodrigo Jimenez corroborated the video’s authenticity.

The revelation about Singh’s immigration status immediately drew sharp criticism from federal officials, including Transportation Secretary Sean Duffy and President Donald Trump. They have consistently pressed the issue of non-citizen commercial driver’s licenses, particularly after a similar fatal crash in Florida in August. Secretary Duffy explicitly stated that the California crash “wouldn’t have happened” if California had adhered to newer federal restrictions.

Last month, the Transportation Department significantly restricted the criteria for non-citizens to obtain CDLs. These new rules mandate that only drivers holding specific visas can qualify:

  • H-2A visas: For agricultural workers.
  • H-2B visas: For temporary nonagricultural workers.
  • E-2 visas: For individuals making substantial investments in a U.S. business.

Additionally, states are now required to verify the immigration status of applicants, and licenses are valid for a maximum of one year or until the visa expires, whichever comes first. Secretary Duffy posted on X, calling the California crash “outrageous” and urging California Governor Gavin Newsom to enforce these new federal actions to prevent further accidents, as reported by the Associated Press.

California’s Stance and Previous Incidents

California is one of 19 states, along with the District of Columbia, that issue driver’s licenses regardless of immigration status, a policy highlighted by the National Immigration Law Center. Governor Newsom’s office countered federal criticism by stating that Singh’s commercial driver’s license was obtained in accordance with federal law, as his federal employment authorization had been approved multiple times.

This incident echoes a deadly crash in Florida just two months prior, where another truck driver, Harjinder Singh, also in the U.S. illegally and holding a California-issued CDL, caused a minivan collision resulting in three deaths. The Trump administration has frequently cited the Florida crash in its disputes with Governor Newsom, particularly regarding immigration and state sovereignty over licensing.

The federal government’s concerns also extend to language proficiency. In April, President Trump issued an executive order declaring truckers who lack English proficiency unfit for service. Secretary Duffy reiterated this stance, stating, “A driver who can’t understand English will not drive a commercial vehicle in this country. Period.”
