‘As Clear As Mud’: Gregg Jarrett Explains How Biden Appointee Twists Due Process To Halt Deportations

Legal expert Gregg Jarrett explained on Fox Business Tuesday how a Biden appointee judge twists due process to block deportations of criminal illegal aliens.

Judge Brian Murphy blocked the deportation of eight migrants held at a U.S. naval base in Djibouti, defying the Supreme Court’s ruling that allowed the Trump administration to deport migrants to countries not specified in their removal orders. During an appearance on “The Evening Edit,” Jarrett said the judge has a different interpretation of “due process.”

“I think what this judge is really doing is standing on a different principle called due process. And, frankly, the Supreme Court has managed to muddle this in a couple of their own decisions,” Jarrett told host Elizabeth MacDonald.

Jarrett said that the Court has contributed to the confusion by muddying the waters on the issue.

“In one in particular, they said ‘Well, they’re entitled to notice.’ Well, notice is not conventional due process, but the Supreme Court has been as clear as mud about that. They’re gonna, in the end, have to clear it up. Murphy said that his earlier May 21 order remained in effect, referencing Justice Sonia Sotomayor’s dissenting opinion. Sotomayor said Murphy’s “remedial orders are not properly before this Court because the Government has not appealed them, nor sought a stay pending a forthcoming appeal.”

In their Monday night filing, the migrants said that all eight individuals, who do not have final removal orders to South Sudan, were deprived of basic procedural rights and protection required by Congress and the Constitution. They said that without injunctive relief, their rights would continue to be violated.
