A tragic January collision near Reagan Washington National Airport, involving an American Airlines regional jet and an Army helicopter that resulted in 67 fatalities, has spurred urgent calls for aviation safety reform. In response, U.S. Senators Ted Cruz (R-TX) and Maria Cantwell (D-WA) are set to announce a significant bipartisan deal on legislation aimed at preventing similar incidents and bolstering overall air safety, sources told Reuters.

Mandatory ADS-B Technology to Enhance Airspace Visibility

At the heart of the proposed legislation is the mandatory implementation of an advanced aircraft-tracking technology known as Automatic Dependent Surveillance-Broadcast, or ADS-B. This system significantly enhances the visibility of aircraft in airspace by broadcasting their position, altitude, speed, and other data to ground stations and other equipped aircraft. The bill requires all aircraft operators to equip their fleets with ADS-B by the end of 2031.

A critical detail highlighted by the January collision is that the Army helicopter involved was not utilizing ADS-B at the time of the accident. The new legislation directly addresses this vulnerability by requiring ADS-B use by military helicopters operating near civilian planes and for all civilian aircraft, closing a long-standing safety loophole. Furthermore, it explicitly eliminates previous exemptions for military helicopters during training, proficiency flights, and flights involving federal officials below cabinet rank, ensuring greater accountability and visibility across military operations in civilian airspace.

Comprehensive Safety Reviews and Inter-Agency Coordination

Beyond ADS-B, the legislation calls for a series of wide-ranging safety reforms designed to proactively mitigate risks. These include:

  • Nationwide Airport Safety Reviews: The bill mandates comprehensive safety reviews across all U.S. airports, moving beyond localized assessments like those previously focused solely on Reagan National Airport. This ensures a holistic approach to identifying and addressing potential hazards.
  • Risk Evaluation of Diverse Airspace Users: The legislation requires the evaluation of risks posed by a broad spectrum of airspace users to commercial flights. This includes traditional military aircraft and helicopters, as well as emerging threats from drones, emergency first responders, and powered lift operations.
  • Army Inspector General Audit: The bill mandates the Army Inspector General’s office to initiate a safety coordination audit, particularly after its previous reluctance to do so. This step aims to improve internal military safety protocols and their integration with civilian aviation standards.
  • Binding Information-Sharing Memorandums: To foster better communication and prevent future mishaps, the legislation requires binding memorandums between the Federal Aviation Administration (FAA) and all military services. These agreements will facilitate the sharing of crucial aviation safety information derived from military mishap reporting systems.

Addressing Long-Standing FAA Oversight Concerns

Lawmakers from both sides of the aisle, including Transportation Secretary Sean Duffy, have openly questioned why the FAA had not taken sufficient action for years to address numerous close calls involving military helicopters operating near Reagan National Airport. The proposed bill directly tackles these concerns by strengthening oversight and mandating coordinated efforts between civilian and military aviation authorities.

This legislative push aligns with ongoing efforts to enhance FAA oversight. For instance, in April, the FAA had already moved to require ADS-B use by government helicopters near Reagan National, and in May, it restricted Army helicopter flights around the Pentagon following another close call. The bipartisan bill from Senators Cruz and Cantwell aims to codify and expand these measures into federal law.

Senator Cantwell, for example, has been deeply involved in the implementation and oversight of the Aircraft Certification, Safety, and Accountability Act of 2020 (ACSAA). A Senate Commerce Committee hearing in March 2023, chaired by Cantwell, specifically examined the reforms mandated by ACSAA and reviewed additional necessary measures to enhance the FAA’s oversight of certification and manufacturing processes.

The current bipartisan bill signals a resolute commitment from lawmakers to proactively address the evolving complexities of modern airspace.
