A settlement of $160,000 has been reached between the city of Sacramento and the father of Dante Dwaine Day, who was fatally shot by police on a light rail train in August 2023 after brandishing a knife.

The city of Sacramento has agreed to pay $160,000 to settle a lawsuit filed by the father of Dante Dwaine Day, a 44-year-old man who was shot and killed by police on a light rail train in August 2023. Day had been brandishing a knife and was shot after lunging at officers, according to NY Post.

The incident occurred on August 15, 2023, when Day boarded a light rail train at Sacramento City College with a knife, causing other passengers to flee in fear. Responding officers found Day sitting alone on the train, clutching the blade, and attempted to de-escalate the situation. However, when Day lunged at the officers with the knife, one of them opened fire, shooting him with lethal rounds.

The city of Sacramento reached a $160,000 settlement agreement with the father of a man who was shot to death by Sacramento police on a Regional Transit light rail train in August 2023. Sacramento PD

Attorney John Burris filed a lawsuit against the police department on behalf of Day’s father, arguing that the officers failed to appropriately handle the situation and that Day was in the midst of a mental health crisis. The lawsuit alleged that the officers should have called for a crisis interventionist instead of using deadly force.

Despite the Sacramento County District Attorney’s Office clearing the officers of any criminal wrongdoing, the city chose to settle the suit for $160,000. The settlement agreement dismisses the federal lawsuit and brings an end to the legal proceedings.

The incident highlights the complexities of policing and the need for officers to be trained in de-escalation techniques, particularly when dealing with individuals in mental health crises. The settlement serves as a reminder of the importance of accountability and the need for law enforcement agencies to prioritize the safety and well-being of all individuals, including those with mental health conditions.
